This policy statement is provided pursuant to Article 13 of Regulation (EU) 2016/679 (“GDPR”) to those who access and navigate the following website: www.adr-area-di-imbarco-a.it (the “Website”) in order to inform the user of the types of cookies used by the Website, how to remove and deactivate them and the rights that can be exercised under the GDPR.


1. WHO IS THE DATA CONTROLLER?

ADR S.p.A., with registered office in Via Pier Paolo Racchetti n. 1, Fiumicino, 00054, is the data controller of your personal data (“ADR” or “Data Controller”).


2. WHAT ARE COOKIES?

Cookies are text files containing information that are stored on your terminal (i.e., computer, tablet or smartphone) every time you visit a website through a browser.
The information encoded in the cookies may also include personal data; in particular, the IP address from which the connection is made, a username, an email address or a unique identifier.


3. WHAT TYPES OF COOKIES DO WE USE?

We use session cookies which are automatically deleted from the device after browsing the Website and permanent cookies which remain stored on your terminal even after the session has ended.
ADR uses first-party cookies (i.e., with the same domain as the Website) and so-called cookies. third party, which originate from other websites that we host within our website.
Firstly, ADR Tel uses technical cookies – the installation of which does not require your consent – in order to guarantee the correct functionality of the Website, provide users with the requested services and keep track of the consent to the installation of the types of cookies that require.
Furthermore, ADR uses analytical cookies in order to compile statistics and understand the ways in which the Website is used by users. The use of analytical cookies is equated to technical cookies if:

  • they are used solely to produce aggregate statistics and in relation to a single site or a single mobile application;
  • for those of third parties, at least the fourth component of the IP address is masked;
  • third parties refrain from combining the analytical cookies, thus minimized, with other processing (customer files or statistics of visits to other sites, for example) or from transmitting them to other third parties. However, third parties are allowed to produce statistics with data relating to multiple domains, websites or apps that can be traced back to the same publisher or business group.

Specifically, ADR uses “Google Analytics” analytical cookies in order to monitor and verify the use of the Website by users. Thanks to Google Analytics, ADR Tel is able to know the “traffic” on its website, the number of times the user opens a multimedia content – both audio and video – the number of people who view and close it before it is finished.
Even in this case, your consent is not required as the solution provided by Google Analytics makes anonymous the IP address of the device from which the connection is made – therefore not allowing it to be identified – and allows you to obtain only aggregate data to perform statistical analyses relating to the performance of the Website.

4. FOR HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

Beyond the times indicated in the preceding tables regarding the permanence of cookies on its terminal, ADR retains the personal data collected through these tracking tools for the time strictly necessary to achieve the purposes for which they are collected; specifically:

  • personal data collected through technical cookies are deleted 12 months after the last browsing session;
  • personal data collected through technical cookies are deleted 24 months after the last session.

6. WHAT ARE YOUR RIGHTS?

Lastly, please be informed that Articles 15-22 of the GDPR give the data subjects the option to exercise specific rights; data subjects can obtain, from the Data Controller: access, rectification, deleting, limitation of processing, withdrawal of consent as well as the portability of data concerning them.
Data subjects also have the right to object to the processing. In the event that the right to object is exercised, the Data Controller reserves the right not to proceed with the request and, therefore, to continue the processing, in the event that there are compelling legitimate reasons to proceed with the processing that prevail over the interests, rights and freedom of the data subject.

The right to file a complaint with the Italian Data Protection Authority pursuant to Article 77 GDPR remains unaffected.
